Participant Waiver and Release of Liability Agreement

Company: Constance K Aromatic Candles LLC

 

Event: Illuminate & Soothe: Candle & Aromatherapy Roll-on Workshop

 

1. Acknowledgment of Risks: The Participant acknowledges that they will be participating in activities including, but not limited to, making candles and body oils (the "Activities") during the classes provided by Constance K Aromatic Candles LLC. The Participant understands that there are inherent risks associated with these Activities, which may include but are not limited to burns, cuts, allergic reactions, and other injuries.

2. Voluntary Participation: The Participant affirms that their participation in the Activities is entirely voluntary and that they have familiarized themselves with the risks associated with these Activities.

3. Assumption of Risk: The Participant agrees to assume all risks, known and unknown, associated with the Activities.

4. Release and Waiver: In consideration of being permitted to participate in the Activities, the Participant agrees to release, waive, discharge, and covenant not to sue Constance K Aromatic Candles LLC, its owners, directors, officers, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant, or to any property belonging to the Participant, while participating in the Activities or while in, on, or upon the premises where the Activities are being conducted.

5. Indemnity: The Participant agrees to indemnify and hold harmless Constance K Aromatic Candles LLC from any loss, liability, damage, or costs, including court costs and attorneys' fees, that they may incur due to the Participant’s participation in the Activities, whether caused by negligence of Constance K Aromatic Candles LLC or otherwise.

6. Medical Treatment: The Participant consents to receive any medical treatment deemed advisable in the event of an injury, accident, or illness during participation in the Activities. The Participant agrees to pay for any medical expenses incurred as a result of participation in the Activities.

7. Severability: The Participant agrees that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

8. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

9. Emergency Procedures: In the event of an emergency, Constance K Aromatic Candles LLC will follow established emergency protocols to manage and mitigate the situation, aiming to ensure the safety and well-being of all participants.

10. Acknowledgment: The Releasor acknowledges that they have had sufficient opportunity to read this entire Agreement, understand its terms, consult with an attorney prior to signing if they felt it necessary, and agree to be bound by its terms.

11. Entire Agreement: This Agreement contains the entire agreement between the parties, and no other agreement, statement, or promise made by any party that is not contained in this Agreement shall be binding or valid.

12. Photo and Video Release: I hereby grant Constance K Aromatic Candles LLC the right to take photographs and video recordings of me during the Event and to use these for promotional purposes, including but not limited to social media, websites, and marketing materials. I understand that I will not receive any compensation for such use.

I understand that I will not receive any compensation for such use. If I do not agree to this, I will notify Constance K Aromatic Candles LLC in writing prior to participating in the Event, and they will do their best to accommodate my request.
